On February 24, 2023, the Drug Enforcement Administration (DEA) released its proposed rules for telemedicine and controlled medications.
Existing patient on controlled substance
If you are a current telemedicine patient prescribed a controlled substance prior to November 7, 2023, the DEA requires you to have a qualified referral on file no later than November 7, 2024, in order to continue treatment.
New patient after November 7, 2023
For a new patient after November 7, 2023, who wants telemedicine service to treat their ADHD, the DEA requires you to have a qualified referral on file before initiating new treatment with controlled substances. Not all patients need treatment with controlled substances. Some ADHD medications are not controlled substances.
